HC rejects request for recognition of an open university degree

Shimla, Mar 21 (UNI) The High Court of Himachal Pradesh on Monday dismissed a petition seeking recognition of the Applicant’s Master’s degree from an open university to make her eligible for the post of English Lecturer on a of contact, contesting the order of the Executive Board, Higher Education of Himachal against the offer of assignment to other candidates in the matter. A divisional bench of the Himachal Pradesh High Court consisting of Justice Tarlok Singh Chauhan and Justice Chander Bhusan Barowalia on Monday passed an order dismissing a petition filed by a Promila Devi from Mandi district. The court issued a 37-page judgment that the degree obtained by the applicant is not in the course or program recognized by UGC and the university was only recognized for one academic year (2009-10) , while the applicant obtained MA (English) during the academic years 2010-2012. The applicant, after obtaining her Bachelor of Arts in 2000, pursued her Bachelor of Education which she obtained in 2007. Subsequently, she obtained her MADegree in English from the Eastern Institute for Integrated Learning in Management (EIILM ) University Sikkim through distance learning mode. . In 2018, the petitioner passed the teacher eligibility test (TGT Arts). An advertisement has been published by the HP Public Service Commission during 2019 to fill various positions for Lecturers (New School) (English) on a contractual basis. The written objective type exam for these positions took place on 16.02.2020 and after passing it, the petitioner was called for a test or personal assessment on 27.11.2020. However, the applicant’s application was rejected on the grounds that the MA degree obtained by the applicant was not recognized, forcing her to file the present request for compensation. The Respondent UGC, said that EIILM University, Sikkim, is a private university which was recognized by the former Distance Education Council (DEC), IGNOU, for a single academic year (2009-2010) to offer distance learning programs, BA (Hospitality and Tourism), BCA and (iii)MBA.
